Product Failures Cause Injury and Death on A Daily Basis

The Law Offices of Jeffrey S. Gilbert June 2, 2021

The United States Consumer Product Safety Commission, or CPSC, works to protect the public from injury or death from thousands of products that may be associated with product failure. The CPSC may call for a product recall, send out public notices and warnings about products that can pose a mechanical, electrical, or chemical hazard, cause a fire, or have a design or materials flaw that can cause injury or death. The CPSC oversees all types of consumer products from children’s toys to medications, to power tools, to household furnishings. The CPSC reports that injury, death, and property damage directly related to consumer product failures cost the U.S. more than $900 billion dollars every year.

Georgia Product Failures Occur without Warning

The CPSC hosts a website that highlights the most up-to-date recall and Georgia product failure information for products made in the United States or from international sources. With over 2,500 product failure recalls every year, the task of the CPSC often seems overwhelming with the need to investigate the product and the company where a report of injury occurred or where product failure is suspected. While it is important that everyone stays safe, children’s product failures often get the most media attention as child safety is every parent or guardian’s concern and priority. Unfortunately, most product failures are not evaluated until after an injury or death occurs.

Atlanta Product Failures and Recalls in The News

Product failure from defective materials or a design flaw can occur in any product on the market. While a local or international company may release a product for sale without knowing there is a defect, has a possible problem-or that it falls short of regulated standards, the company remains responsible for injuries, death, or damage that is the result of their product failure. Retaining experienced Georgia product failure counsel is critical for success in filing a product failure claim against a giant corporation, an internationally known brand, or U.S. sales leader. Jeff Gilbert is the attorney who is not afraid to take on giants in the manufacturing industry, and who is ready to prepare a winning battle for optimal benefits and compensation.

There are numerous products on the product failure recall list right now. The list continues to grow as more and more products are discovered to have a defect, a flaw, or one which has caused personal injury or death. Some recent 2013 examples of U.S. and Atlanta product failures in the news where they have agreed to settle by paying civil penalties are:

Whalen Furniture will pay $725,000 for failure to report a defective child’s bed after a toddler was killed when the lid of the bed’s toy chest fell down on the back of his head and trapped his neck on the edge of the toy chest. Whalen Furniture did not report the death or the hazard until CPSC became involved.

The large department store Bon-Ton to pay $450,000 for failing to report drawstrings on children’s jackets and sweatshirts when the company knew they were a safety concern. CPSC investigated complaints and found the drawstrings that ran through the hoods of the jackets and sweatshirts were a strangulation hazard.

A recent recall where the product has caused more than one death is:

Five infants were killed due to defects and product failure in the design, warnings, and instructions of the Nap Nanny and Chill Infant Recliners. A total of over 70 additional injury reports have been filed. The infants suffered from entrapment, suffocation, and fall hazards.

Other examples of the variety of product failure recall that have been listed in the first weeks of February 2013 are:

The well-known company Samsonite recalls dual-wattage travel converter kit due to fire and burn hazards

Bohning recalls hunting crossbows when it is discovered that it can fire unexpectedly causing injury to the shooter and by-standers

Ski-Doo Snowmobiles are recalled after it was found that fuel pump fittings have broken causing a fuel leak and a fire hazard.
