Uncapped Punitive Damages
Georgia imposes a $250,000 cap on punitive damages in most personal injury cases. O.C.G.A. Section 51-12-5.1(f) removes that cap entirely when the defendant drove while impaired. There is no statutory ceiling on what a jury may award against a drunk driver. Georgia uses a bifurcated process: the jury first determines compensatory damages and whether punitive damages are warranted, then, in a separate phase, sets the punitive amount after hearing evidence, including the defendant’s prior DUI history.
Dram Shop Liability
Under O.C.G.A. Section 51-1-40, Georgia’s Dram Shop Act, a bar, restaurant, liquor store, or other establishment that knowingly served a visibly intoxicated person, knowing that person would soon be driving, can be held civilly liable. A dram shop claim runs alongside the claim against the driver. It opens a separate pool of insurance coverage and assets, which matters significantly when the driver carries only minimum limits or no coverage at all.
Modified Comparative Fault & the Filing Deadline
Georgia follows modified comparative fault under O.C.G.A. Section 51-12-33: a victim’s recovery is reduced by their own percentage of fault, and a victim found 50% or more at fault can’t recover. Insurers routinely try to assign partial blame to DUI victims to shrink payouts. Georgia also sets the legal blood alcohol concentration limit at 0.08% for most drivers, 0.04% for commercial drivers, and 0.02% for drivers under 21 under O.C.G.A. Section 40-6-391.
