Who Can File a Wrongful Death Claim in Georgia?
Georgia Code § 51-4-2 (2024) establishes a specific order of priority for who has the right to file a wrongful death claim. The surviving spouse holds the primary right to file and can also represent the interests of any minor children.
If there is no surviving spouse, the right to file passes in this order:
- Adult children of the deceased can file if there is no surviving spouse
- Parents of the deceased have the right to file if there is no surviving spouse or children
- The administrator or executor of the estate can file if none of the above family members exist
