Wrongful Death Damages in Georgia

Georgia law demands compensation for the full value of a life from the deceased's perspective. This can be a powerful tool even if the decedent was not a millionaire. In the 1932 case Western & R. Co. v. Michael, 175 Ga. 1, 13, 165, the court ruled that "the aim of these [wrongful death] statutes is to strike at the evil of the negligent destruction of human life, by imposing liability upon those who are responsible either directly through themselves or directly through their employees for homicides. It is not beyond the power of the legislature to attempt to preserve human life by making homicide expensive."

By "making homicide expensive," the person who causes the wrongful death of another is forced to suffer a financial penalty to the person who may legitimately file a wrongful death claim, essentially suing for negligent homicide, on behalf of the deceased. Georgia wrongful death law is unique. The historical development of wrongful death damages in the state is recorded in Brock v. Wedincamp, 253 Ga. App. 275, 558 S.E.2d 836 (Ga. App. 2002).

Brock states: "It is clear...that under Georgia's wrongful death statute, damages are measured from the decedent's point of view....[T]he measure of the recovery is the full value of the life of the deceased, irrespective of its value to the person in whom the cause of action is vested [i.e. the spouse or children]." As recognized in Georgia's leading treatise on wrongful death actions, this state is unique in how it measures damages for a wrongful death because it "compensates the value of the decedent's life to him."
